What is personal information?

A)

Under the Personal Information Protection Act (PIPA) , personal information means any information that identifies you as an individual such as but not limited to name, address, phone number, age, marital status, employment history.

What is valid consent and how do I give it?

A) Valid consent requirements:
 

The Credit Union must not collect, use or disclose personal information about an individual, unless:

  • the individual gives consent to the collection, use or disclosure (express consent)
  • PIPA deems the collection, use or disclosure to be consented to by the individual (implied consent)
  • PIPA authorizes the collection, use or disclosure without consent (exemptions from consent requirements).

Consent has not been given:

  • unless the Credit Union has provided the individual with the information about purpose and contact information for persons who can answer questions
  • unless the individual's consent is provided in accordance with PIPA (i.e. not beyond what is necessary)
  • if the Credit Union uses false or misleading information when collecting, using, or disclosing information or uses deception or misleading practices.

1) Express consent:

Express consent can be obtained:

  • in writing - the purpose must be clear
  • orally (e.g. in person or by phone) - consent must be clear and unambiguous and include purpose and other details necessary to give valid consent and documented

2) Implied Consent:

An individual is deemed to consent to the collection, use or disclosure of personal information by the credit union for a purpose if:

  • at the time the consent is deemed to be given, the purpose would be considered obvious to a reasonable person, and
  • the individual voluntarily provides the information for that purpose.

May I withdrawal consent at any time?

A) An individual can withdraw consent at any time however this may affect our ability to provide you with the product or service you have asked for. You may opt-out of receiving direct marketing materials by completing an Opt Out Request Form.

Why do you collect my personal information?

A)

PIPA requires that on or before collecting personal information from an individual, the Credit Union must disclose to the individual, orally or in writing:

  • the purpose of collection
  • on request, the position name or title and contact information for an officer or employee that can answer the individual's questions about collection and purpose of the collection.

Here are some reasons for the collection of information:

  • to open an account for you, we need to complete Membership and/or Deposit Services Application and Signature Card.
  • we request your SIN because the government requires us to obtain it for reporting your dividends on your shares and the interest you earn on your deposits.
  • to obtain your credit report in order to help verify your identity and because there is a credit risk to the credit union when opening an account.
  • to complete the information in a Loan Application to see whether you qualify and what amount under our policies.
  • to provide third party information because it is required by money laundering legislation.
